Terms and Conditions of the Online Store www.heikiheiki.com including the Terms of Service
The online store operating under the Internet address www.heikiheiki.com is run by HEIKI HEIKI SASU, 37 Rue D'Amsterdam, 75008 Paris, France, SIREN 940207921.
-
Price – the monetary value the Customer undertakes to pay to HEIKI HEIKI for a Product. The Price is a gross amount payable.
-
Price before discount – the Product price before applying a reduction.
-
Lowest price within 30 days prior to discount – the lowest price at which the Product was available in the Store during the last 30 days before the discount was applied.
-
Discounted Price – the Product price in the Store after the discount is applied.
-
Cookies – text files sent by the web server and stored by the Internet browser on the hard drive of the Customer’s computer or other end device, used for accessing websites.
-
Delivery – the actual act of delivering the Product specified in the order to the Customer by the Seller, via a Carrier.
-
Business Day – a day from Monday to Friday, excluding public holidays in France.
-
Order Form – an electronic form available on www.heikiheiki.com by which the Customer can purchase Products from Heiki.

Complaint Form – an electronic form available on www.heikiheiki.com through which the Customer may submit a Complaint.

Password – a sequence of characters used to identify the User, consisting of at least 8 characters, containing lowercase and uppercase letters and numbers or special characters. The Password cannot be identical to the User’s first and last name.

Product Page – a subpage of the Store containing information about a specific Product.

Customer – a natural person with full legal capacity (and in cases provided for by law, also a person with limited legal capacity), a sole proprietor, as well as a legal person or organizational unit without legal personality, granted legal capacity by law, intending to or having concluded a Sales Agreement with Heiki for Products, or a contract for electronic services.

Consumer – a natural person making a legal transaction with an entrepreneur not directly related to their business or professional activity.
-
Cart – a list of Products selected by the Customer from the Store’s offer or electronic services.
-
Account – a part of the Store accessible to the Customer after logging in with a login and password, containing data entered by the Customer, including order history, order status, and access to subscriptions.

Login – the Customer’s e-mail address provided during the creation of an Account.
-
Place of Delivery – the postal address or pick-up point indicated by the Customer in the Order for delivery of the Product.
-
Moment of Delivery – the moment the Customer or an authorized third party takes possession of the Product.
-
ODR Platform (Online Dispute Resolution) – an EU website for resolving consumer disputes in e-commerce, operating under Regulation (EU) No 524/2013, available at: ec.europa.eu/odr.

Payment – payment for the Product and Delivery.
-
Product – an item available in the Store that may be subject to sale.
-
Entrepreneur – an entity concluding a contract with Heiki as part of its business activity, not being an Entrepreneur with Consumer rights.
-
Entrepreneur with Consumer Rights – a natural person concluding a contract directly related to their business activity, but where the contract does not have a professional character for them (in particular due to their business profile in CEIDG).

Pick-up Point – a place designated by Heiki where the Product may be collected, other than the Customer’s address.
-
Store – the online service available at www.heikiheiki.com through which the Customer can conclude a sales agreement or an agreement for digital/electronic services.
-
Lead Time – the number of hours or Business Days stated on the Product Page necessary to complete an Order.
-
Digital Content – data produced and delivered in digital form.
-
Sales Agreement – a contract for the sale of Products within the meaning of the Civil Code, concluded between Heiki and the Customer, via the Online Store or other distance communication, for the agreed Price plus any additional fees.

Electronic Service – a service within the meaning of the Act of 18 July 2002 on the provision of services by electronic means, provided electronically by Heiki via www.heikiheiki.com.

Digital Service – a service allowing the Customer to: (1) generate, process, store, or access data in digital form; (2) share data in digital form created by the Customer or other users; (3) interact using digital data.

Consumer Rights Act – the Act of 30 May 2014 on Consumer Rights.

Act on the Provision of Electronic Services – the Act of 18 July 2002 on the Provision of Services by Electronic Means.

Order – the Customer’s declaration of intent submitted via the Store, directly aimed at concluding a Sales Agreement with HEIKI HEIKI for Products, or an agreement for the supply of digital content.
§2 General Information

These Terms and Conditions define the rules and principles of using the Online Store, available at www.heikiheiki.com (including all subpages and tabs at that address), operated by HEIKI HEIKI.

These Terms and Conditions are addressed to both Customers who are Consumers and Customers who are not Consumers, using the Store or electronic/digital services.
-
These Terms and Conditions constitute the regulations referred to in Article 8 of the Act of 18 July 2002 on the Provision of Services by Electronic Means and govern the terms of concluding Sales Agreements in the Store.

Acceptance of these Terms and Conditions is voluntary, but necessary in order to create an Account, place an Order, conclude a Sales Agreement, or use electronic/digital services.

The Terms and Conditions are made available to the Customer free of charge before the conclusion of a Sales Agreement for Products offered in the Store, by posting them on the website www.heikiheiki.com.

The content of the Sales Agreement is additionally recorded and secured in the Store’s IT system. HEIKI HEIKI may also provide electronic services to the Customer.

The Store is used to purchase Products and also to:

provide Customers with information about Products,
-
allow browsing of content made available in the Store,
-
enable registration of a Customer Account,
-
allow the posting of content in the Store,
-
enable submission of reviews of Products or Services purchased or offered by the Seller,
-
provide a Newsletter.

HEIKI HEIKI does not charge any fees for communication using distance means. The Customer shall only bear the costs arising from the agreement concluded with a third-party provider of telecommunication services.
§3 Electronic and Digital Services
General Provisions

Through the Store, HEIKI HEIKI provides the following electronic and digital services free of charge to Customers:

Account,
-
registration form,
-
Order Form,
-
displaying advertising content tailored to Customers’ interests, including, depending on the Customer’s voluntary consent, sending browser push notifications,
-
providing Customers with a Cart function,
-
enabling browsing of content in the Store,
-
maintaining Customer sessions after logging in to the Account,
-
storing and providing access to the Customer’s Order history through the Account,
-
Newsletter.
-
-
HEIKI HEIKI undertakes actions to ensure the proper functioning of the Store.
-
The Customer agrees to use the Store and its electronic/digital services lawfully, in particular to:
-
provide only true, up-to-date, and necessary data in the Store’s forms,
-
promptly update data, including personal data, when necessary for proper performance of contracts,
-
not provide unlawful content (e.g., promoting violence, defamatory, infringing on personal rights or third-party rights),
-
respect the rights of HEIKI HEIKI and third parties, including copyrights and intellectual property rights,
-
use the Store in a manner that does not disrupt its functioning,
-
not engage in activities such as spamming,
-
use the Store without causing inconvenience to other Customers or to HEIKI HEIKI,
-
not attempt to access information not intended for the Customer (e.g., data of other Customers),
-
not modify unlawfully the content provided by HEIKI HEIKI, in particular prices or product descriptions,
-
use all content provided in the Store only for personal use,
-
use the Store in compliance with applicable law, these Terms and Conditions, and good practices.

Access to the Store’s electronic or digital services requires an Internet-enabled device with a commonly used browser. Minimum technical requirements: Firefox 64, Chrome 71 (incl. Chrome for Android), Safari 12.1 (incl. iOS Safari 12), Opera 58 (incl. Opera Mobile), Edge 18 – all with JavaScript, Cookies, and Local Storage enabled.

HEIKI HEIKI declares that the public nature of the Internet and electronic services may pose a risk of unauthorized acquisition, appropriation, or modification of Customer data. Customers should therefore use appropriate technical measures, such as antivirus or identity protection software.

Electronic services are provided 24/7, on demand.
Account
-
The Account is provided for an indefinite period. Creating an Account is not required to place an Order.
-
Registration and use of the Account requires the Customer to:
-
fill in the registration form (including: name, surname, e-mail address (Login), phone number, and creation of a Password),
-
accept these Terms and Conditions,
-
read the Privacy Policy,
-
click “Register”,
-
confirm activation by clicking the activation link sent to the provided e-mail (valid for 3 hours).
-

The Customer is obliged to keep their Password confidential. Only one Account per e-mail address is allowed.
-
The Account enables the Customer to enter, edit, or delete data, manage delivery addresses, place Orders, view Order history and status, manage payments, and subscribe/unsubscribe from the Newsletter.
-
If the Customer forgets their password, they may use the “Forgot Password” option, after which a reset link will be sent by e-mail.
-
The Customer may delete their Account at any time by sending a request to support@heikiheiki.com The request will be verified and the Account deleted promptly, terminating the electronic service agreement for the Account.
-
HEIKI HEIKI may block the Customer’s Account if:
-
the Customer uses the Store unlawfully, infringes rights of others, or violates good morals,
-
the Customer repeatedly (at least twice) breaches these Terms and Conditions,
-
the Customer repeatedly (at least twice) provides false delivery data preventing Delivery.
-

The Customer will be informed by e-mail if their Account is blocked. Blocking the Account terminates the agreement with immediate effect.
Newsletter
-
With separate consent, the Customer may subscribe to the Newsletter service.
-
The Newsletter is sent electronically to the Customer’s e-mail and contains commercial information, in particular (but not limited to): Products, new arrivals, bestsellers, discounts, discount codes, Store or HEIKI HEIKI activities, events, blog posts, as well as remarketing-type messages (welcome messages, abandoned cart reminders, etc.).

Newsletters are sent periodically or after certain actions, e.g. when leaving a Product in the Cart.
-
Automated systems may be used for sending the Newsletter.
-
The Newsletter is provided for an indefinite period, and the Customer may unsubscribe at any time via the “unsubscribe” link included in each message.
-
Subscription requires providing an e-mail address and clicking “Subscribe” (or equivalent) and confirming acceptance of the Privacy Policy and Terms and Conditions.
-
By subscribing, a contract for the supply of Digital Content is concluded.
-
HEIKI HEIKI is responsible for compliance of the Newsletter with the contract for 2 years from delivery, in accordance with the Consumer Rights Act.
-
Complaints about the Newsletter can be submitted, and HEIKI HEIKI will respond within 14 days.
Complaints Regarding Electronic Services
-
Complaints regarding electronic services provided by HEIKI HEIKI may be sent by e-mail to: support@heikiheiki.com or in writing to: HEIKI HEIKI SASU, 37 Rue D'Amsterdam, 75008 Paris, France, SIREN 940207921.

The complaint should include Customer’s contact details, a description of the problem (including the date), and the Customer’s request.
-
HEIKI HEIKI will reply without undue delay, no later than within 14 days.
§4 Sale of Products
Conclusion and Performance of the Sales Agreement
-
HEIKI HEIKI reserves the right to change Product Prices, introduce new Products, carry out and cancel promotions, or modify them, in compliance with the law.
-
A Sales Agreement between the Customer and HEIKI HEIKI may be concluded after the Customer places an Order.
-
Orders for Products can be placed 24/7.
-
The total value of the Order includes the Price, shipping costs, and any other selected service costs. The Customer is informed about the total cost (including taxes and delivery fees) before confirming the Order.
-
To place an Order, the Customer must:
-
Add Product(s) to the Cart,
-
Fill in the Order Form with identification data (or invoice data if applicable),
-
Choose one of the available Delivery options,
-
Choose the method of Payment,
-
Select the Place of Delivery,
-
Accept the Terms and Conditions and confirm having read the Privacy Policy,
-
Confirm the Order using the “Buy and Pay” button.
-
-
Immediately after placing the Order, the Customer receives an e-mail confirmation from HEIKI HEIKI.
-
After verifying the Order, HEIKI HEIKI sends an e-mail with:
-
confirmation of acceptance of the Order for execution, or
-
information about refusal or cancellation (in whole or in part).
-
-
The Sales Agreement is concluded upon confirmation of acceptance of the Order.
-
The condition for processing prepaid Orders is that HEIKI HEIKI receives the payment. If payment is not received, the contract is deemed not concluded.
-
Purchased Products are shipped via the selected Delivery method to the Place of Delivery indicated by the Customer.
-
HEIKI HEIKI may inform the Customer about the Order status by e-mail.
Payment Methods
-
HEIKI HEIKI provides various payment methods, specified in the “Payment Methods” tab at www.heikiheiki.com. Available methods include:
-
electronic payment via online payment system,
-
payment by card,
-
traditional bank transfer
-
-
For non-Consumer Customers, HEIKI HEIKI may limit available payment methods or require advance payment.
Delivery
-
Delivery of Products is available within Europe via courier shipment.
-
Delivery is paid unless otherwise specified. HEIKI HEIKI may introduce free delivery above a specified order value.
-
Delivery costs are shown in the “Delivery Methods” tab on the website and before concluding the Sales Agreement.
-
The Order lead time is generally 1–3 business days (up to 5 in exceptional cases), counted from the receipt of payment (or from order placement in the case of COD orders).
-
If the Customer is an Entrepreneur (excluding Entrepreneurs with Consumer Rights), benefits and risks (including accidental loss/damage) pass to the Customer at the moment HEIKI HEIKI hands over the Product to the carrier. HEIKI HEIKI is not liable for delays caused by the carrier.
§5 Licenses

The exclusive rights to the content made available or placed in the Store by HEIKI HEIKI or its contractors, in particular copyrights, the Store name, trademark, or software, as well as database rights, are legally protected and belong to HEIKI HEIKI or entities with which Heiki has concluded relevant agreements.

The Customer is entitled to use such content free of charge, as well as to use content lawfully placed and already disseminated by other Customers within the Store, but only for personal use and solely for the proper use of the Store. Any use beyond this scope is permitted only with the prior, explicit written consent of the entitled entity.
-
Within the Store, HEIKI HEIKI may present Customer-generated content, including Customer reviews of purchased Products, as well as Customer questions concerning Products. Submission of a review or question is possible via a special form on the Product Page. HEIKI HEIKI may also ask Customers by e-mail to provide a Product review. Before submitting, the Customer must confirm having read the Privacy Policy and accept these Terms and Conditions.

Reviews or questions may concern only a specific Product. Customers may not include in reviews/questions:
-
advertising content (including hidden advertising or product placement),
-
content not related to the Product,
-
unlawful, offensive, or hate-inciting content (racial, religious, ethnic, etc.),
-
violent or vulgar content,
-
works protected by copyright without holding the necessary rights.
HEIKI HEIKI reserves the right to remove reviews/questions that do not comply with these Terms and Conditions.

If a review or question constitutes a “work” under the Copyright Act of 4 February 1994, the Customer, by posting it, grants HEIKI HEIKI a perpetual, non-exclusive, royalty-free license to:
-
store such content in HEIKI HEIKI’s IT system,
-
reproduce it by any technique (including print and digital),
-
distribute it (in particular online and via other media),
-
market, lend, or lease copies,
-
publicly perform, display, broadcast, rebroadcast, or make available in such a way that anyone may access it at a place and time of their choice,
-
adapt, modify, supplement, or translate it,
-
grant sublicenses to third parties for the above purposes.
-

HEIKI HEIKI publishes only genuine Customer reviews and does not commission anyone to write reviews of its Products.
§6 Complaints
Complaints from Consumers and Entrepreneurs with Consumer Rights
-
The Seller is responsible towards Customers who are Consumers or Entrepreneurs with Consumer Rights for the conformity of Products with the Sales Agreement, in accordance with Chapter 5a of the Consumer Rights Act.
-
If a Product is not in conformity with the Sales Agreement, such Customer has the right to file a complaint. A Complaint Form (Appendix No. 3) may be used. Complaints should be sent to: HEIKI HEIKI SASU, 37 Rue D'Amsterdam, 75008 Paris, France, SIREN 940207921.
-
The Seller is liable for any lack of conformity that existed at the time of delivery and that appears within two years from delivery, unless the expiry date is longer. HEIKI HEIKI is not liable if the Customer was clearly informed prior to purchase that the Product was incomplete/defective and accepted it.
-
In the event of non-conformity, the Customer may request:
-
repair of the Product, or
-
replacement of the Product.
-
-
If the chosen remedy is impossible or would involve excessive costs, the Seller may instead offer the alternative (repair instead of replacement or vice versa).
-
If both repair and replacement are impossible or excessively costly, the Seller may refuse to bring the Product into conformity. When assessing excessive costs, account shall be taken of:
-
the value of a conforming Product,
-
the significance of the lack of conformity,
-
inconvenience for the Customer.
-
-
In such cases, the Customer must make the Product available to the Seller for repair/replacement. The Seller shall do so within a reasonable time without undue inconvenience.
-
The Seller bears the cost of repair or replacement.
-
If non-conformity persists, the Customer may demand:
-
a price reduction, or
-
withdrawal from the agreement with a refund.
-
-
The reduced Price must be in proportion to the reduced value of the Product compared to a conforming one.
-
The Customer cannot withdraw from the contract if the non-conformity is minor.
-
In case of withdrawal, the Customer must return the Product at the Seller’s expense to HEIKI HEIKI.
-
Refunds (price reduction or withdrawal) shall be made by the Seller immediately, no later than within 14 days of receiving the Product or proof of return.
-
If the non-conformity relates only to certain Products under the contract, withdrawal may apply only to those, unless keeping the rest is unreasonable for the Customer.
-
Refunds are made using the same payment method unless the Customer agrees otherwise.
Complaints from Entrepreneurs (not Consumers)
-
Shortages in quantities (collective packaging) must be reported on the day of Delivery; other shortages must be reported within 7 days, provided the security seal is intact.
-
HEIKI HEIKI grants Entrepreneurs (excluding Entrepreneurs with Consumer Rights) a 24-month warranty for quality defects from the date of delivery, under the terms specified herein. Civil Code provisions on warranty are excluded.
-
Defects must be reported within 7 days of detection via e-mail to: support@heikiheiki.com. Confirmation of sending the e-mail serves as proof of notification. HEIKI HEIKI will acknowledge receipt on the same or next business day.
-
HEIKI HEIKI must respond to the complaint without undue delay, no later than 14 days, and provide supporting analytical test results if relevant.
-
Both parties must preserve all evidence (samples, documents, etc.) useful in resolving the dispute. HEIKI HEIKI is obliged to present such evidence to the Entrepreneur upon request.
-
If a complaint is accepted, HEIKI HEIKI will promptly deliver missing Products or replace defective ones with non-defective ones. Replacement is the only available remedy.
-
If a complaint is rejected, the parties shall attempt amicable resolution. If not possible, the dispute will be referred to an independent laboratory.
-
If no laboratory is chosen jointly within 30 days, HEIKI HEIKI shall appoint one.
-
Costs of laboratory testing are shared equally as an advance. The losing party shall reimburse the winning party for the full costs once the test results are issued. The laboratory’s decision is binding.
§7 Right of Withdrawal from the Sales Agreement
-
A Customer who is a Consumer or an Entrepreneur with Consumer Rights, who has concluded a distance contract or created an Account in the Store, may withdraw from the Sales Agreement or the Account Agreement within 14 days, without giving any reason and without incurring costs other than those provided by law. In the event of withdrawal, the agreement shall be considered not concluded.

The withdrawal period for a Sales Agreement begins on the day the Customer (or a third party other than the carrier, indicated by the Customer) takes possession of the Product. For an Account Agreement, the withdrawal period begins on the day the Customer gains access to digital content or services.
-
To meet the deadline, it is sufficient for the Customer to send a clear statement of withdrawal before its expiry.

or via the dedicated Withdrawal Form available at www.heikiheiki.com.

Products should be returned to: HEIKI HEIKI SASU, 37 Rue D'Amsterdam, 75008 Paris, France, SIREN 940207921.
-
The Seller will immediately confirm receipt of the withdrawal statement to the Customer’s e-mail address.
-
Customers may use the withdrawal form templates (Appendix No. 1 – for Consumers, Appendix No. 2 – for Entrepreneurs with Consumer Rights), though this is not mandatory.
-
An Entrepreneur with Consumer Rights must additionally declare in their withdrawal statement that the Sales Agreement concluded is not of a professional nature related to their business activity. If the agreement is professional in nature, the Entrepreneur cannot withdraw.
-
The Consumer must return Products within 14 days of withdrawal. Proof of posting before expiry is sufficient. The Consumer bears the cost of returning Products. A purchase receipt is recommended for smoother processing.
-
If the Consumer selected a delivery method other than the cheapest available, the Seller is not obliged to refund additional costs.
-
The Seller refunds payments within 14 days of receiving the withdrawal statement, using the same payment method as originally used unless otherwise agreed.
-
If payment was made by COD (cash on delivery), the Customer must provide a bank account number for the refund.
-
The Customer is responsible for any reduction in the value of the Product resulting from use beyond what is necessary to establish its nature, characteristics, and functioning.
-
The right of withdrawal does not apply to contracts:
-
for services fully performed with prior consent of the Customer,
-
for Products with a short shelf life,
-
for sealed Products that cannot be returned for health or hygiene reasons once opened,
-
for Products that, due to their nature, are inseparably combined with other goods after delivery.
-
§8 Liability
-
HEIKI HEIKI, as well as its employees, representatives, and agents, shall not be liable to Customers who are not Consumers or Entrepreneurs with Consumer Rights, for any damages including lost profits, unless caused intentionally.
-
HEIKI HEIKI’s liability towards Customers who are neither Consumers nor Entrepreneurs with Consumer Rights is limited to the amount of the Price paid plus Delivery costs, but not exceeding PLN 1,000. Liability is limited to foreseeable, typical damages at the time of contract conclusion. No liability for lost profits.
§9 Protection of Personal Data

The Customer’s personal data is processed by HEIKI HEIKI as the data controller.
-
Providing personal data by the Customer is voluntary but necessary in order to create an Account, use certain Electronic Services, or conclude a Sales Agreement.
-
Additional explanations regarding the protection of personal data are included in the “Privacy Policy” tab available in the Store at: www.heikiheiki.com
§10 Final Provisions

HEIKI HEIKI may amend these Terms and Conditions at any time on the basis of generally applicable legal provisions if at least one of the following important reasons occurs:
-
a change in legal provisions governing the sale of Products or the provision of electronic services, affecting the mutual rights and obligations specified in the agreement concluded between the Customer and HEIKI HEIKI, or a change in the interpretation of such provisions as a result of court judgments, decisions, recommendations, or guidelines issued by competent authorities;
-
a change in the method of service provision caused solely by technical or technological reasons (in particular, an update of technical requirements indicated in these Terms and Conditions);
-
a change in the scope or type of services covered by these Terms and Conditions, through the introduction of new functionalities or services, the modification of existing ones, or the withdrawal of those previously offered by HEIKI HEIKI.

These Terms and Conditions are effective as of 15 August 2025 and are available to Customers free of charge at: www.heikiheiki.com
